Why India's Government Cannot Easily Seize Long-Abandoned Properties

India does not have a single, unified law to deal with abandoned buildings. Instead, a patchwork of regulations across different states and municipal acts governs what happens to these properties. This makes it difficult for the government to simply take over or demolish abandoned structures, even if they have been vacant for decades. Municipal authorities have the power to inspect buildings and classify them as dangerous. Once a building is deemed unsafe, the owner is notified and ordered to carry out repairs or secure the property. In cases where there is an immediate risk of collapse, the authorities can demolish the building. However, this process is often slow and legally complex. The main challenge is that property rights are strongly protected under the law. The government cannot seize private property without going through a long legal procedure, such as proving that the owner has abandoned it or that the building poses a severe public hazard. Even then, the owner may contest the action in court. Some states have taken steps to address the issue. For example, both Maharashtra and Delhi have made structural evaluations mandatory for older buildings. In Mumbai, buildings over 30 years old must undergo regular safety checks. Despite these measures, many abandoned properties remain untouched due to ownership disputes, unclear titles, or the high cost of redevelopment. Without a comprehensive law, local bodies rely on fragmented powers, which often results in delays and legal battles. Until a clearer legal framework is established, abandoned buildings will continue to pose safety risks and remain a challenge for urban authorities.
