Krishna Janmabhoomi-Shahi Idgah Dispute: Court Cites 1920 Notification, Allows Suits to Proceed

A long-standing dispute over a religious site in Mathura has taken a new turn. The site is claimed by Hindus as the birthplace of Lord Krishna, where a temple once stood, and by Muslims as the location of the Shahi Idgah mosque. The Allahabad High Court recently ruled on a key legal challenge. The court relied on a government notification from 1920, which indicated the existence of a pre-Aurangzeb temple at the site. However, the court also stated that the religious character of the structure cannot be determined at this stage of the proceedings. The court dismissed the mosque committee's argument that the lawsuits filed by Hindu parties are barred by the Places of Worship Act, 1991, which prohibits changing the religious character of any place of worship as it existed on August 15, 1947. The court noted that the applicability of the Act would be examined later. This legal battle involves a compromise agreement reached decades ago between the temple and mosque authorities, which is now being challenged by Hindu petitioners who seek to reclaim the entire site.
